Technology Solutions - Rates And Terms

SECTION TWO: RATES AND TERMS
A. Payment Terms

Standard payment terms for all services and purchases are Net-10 days. Billing statements are normally sent bi-monthly, or upon completion of a project or delivery of materials.

Purchases of software and/or hardware that are over $2,000 require fifty percent down. Payment is due at time of order, with balance due upon delivery. Term variations can be discussed. For acceptance of an order, client must sign our estimate sheet and fax entire document back to 206.842.5978.

Washington state sales tax and shipping expenses will be added to the final invoice when applicable. A late fee of 5% of the outstanding balance will be assessed for all overdue amounts. Interest at the rate of 1_% per month will also be assessed to all overdue amounts, including late fees, and will continue to accrue. In the event of any lawsuit in relation to this agreement, the client agrees to venue in Kitsap County and the prevailing party shall be entitled to reimbursement of any reasonable court costs and attorneys' fees incurred in that suit.

Included with an invoice is a description of the billable hours incurred on the customer's behalf. Please call as soon as possible if you have any questions. We will only accept billing questions within 30 days of the invoiced date.
B. Standard Rates

Our normal hourly service rate is $125 an hour, technician hourly rate is $90 an hour, and emergency and after hours fee is 2x the normal hourly rate. Senior Engineering Services are $150 an hour associated with router programming, email server configuration, and wide area network design and implementation services. Day rate for out of territory work is $1,050 and based on a 10 hr. workday plus expenses. After 10 hrs. normal hourly rates apply. Project rate is $ 105 an hour. Projects are definable as a written estimate for a specific implementation that exceeds 20 hrs. in labor.

Project wiring is $60 an hour, and normal wiring is $125 per hour. We do not bill trip charges or parking fees for service in metropolitan King and Kitsap counties.

Requests for in-depth research - Occasionally, companies request in-depth technical research and needs analysis. For new clients, we will conduct a basic one time on-site evaluation, at no charge, which typically lasts one hour. There is a charge, however, to draw up in-depth project plans, bill of material lists, price estimates for budgeting purposes, and make technical assessments and recommendations.
SECTION THREE: TECHNICAL SOLUTIONS OEM and VAR WORKSTATION / SERVER WARRANTY TERMS AND CONDITIONS
As an OEM and VAR, Technical Solutions warrants that its custom-constructed workstations and servers will be free from defects in materials and workmanship for a period of three years from the date of invoice. Technical Solutions also warrants that its computer systems will perform in accordance with all advertised claims and meets or exceeds all advertised standards and certifications. Warranty coverage includes, but is not limited to system board, processor, memory, storage devices and monitor.
A. Terms of Warranty

Computer system warranty coverage is for three years from the date of invoice.

Computer systems must be properly maintained i.e., serviced and cleaned every 6 to 9 months, documentation of all maintenance should be made available upon request.

Individual parts, components, peripherals and items purchased from Technical Solutions not yet integrated into a Technical Solutions computer system at the time of original purchase, but installed by Technical Solutions staff are covered by a ninety (90) day warranty. After 90 days the item is covered by the manufacturers warranty.

Individual parts, components peripherals and items, which have been provided as warranty replacement, are covered for (90) days. After 90 days, the items will be covered by the manufacturers warranty.

Technical Solutions reserves the right to make comparable substitutes on parts based on availability.

Warranty does not cover damages or failures resulting from misuse, abuse, neglect, acts of nature, electrical problems, improper installation, software glitches, or lack of proper maintenance.

Warranty coverage will be void if repairs or modifications are attempted or performed without prior authorization from Technical Solutions.

Technical Solutions is not liable or responsible for any loss, financial or otherwise resulting from product failure, down time or loss of data.

Technical Solutions reserves the right to determine whether material or workmanship are defective and is entitled to repair or replace defective materials or products at its sole discretion.

Warranty is valid if customer delivers/sends computer system in appropriate packaging to the Technical Solutions repair center or if arrangements have been made for system to be picked up by a Technical Solutions staff member for delivery to the repair center.

Purchase of Technical Solutions workstations and servers constitutes acknowledgement and acceptance of Technical Solution's Warranty Program & Policies.

Any warranty claims must be made prior to the expiration of warranty coverage.

Warranty claims and technical problems should be directed to Technical Solution's Support Department at 1.206.842.5957 or 1.888.700.5957 between 9:00am and 5:00 pm, M-F on normal business days.

Warranty coverage is void for late or non-payment under agreed to or established payment terms.

Technical Solutions makes no warranty whatsoever with respect to software included in any products sold by Technical Solutions, and all software is sold "as is" and "with all faults".

All other products sold through Technical Solutions carry only the warranties provided by the manufacturer.
B. Conditions of Warranty

If any provision of this contract shall be deemed in conflict with any statute or rule of law, such provision shall be deemed modified to be in conformance with said statute or rule of law.

This contract, including attachments, contains all the terms and conditions agreed upon by the parties. No other understanding, oral or otherwise, regarding the subject matter of this contract shall be deemed to exist or to bind any of the parties hereto.

This agreement contains all the terms and conditions agreed upon by the parties. Any amendments or changes to this agreement must be mutually agreed to by both parties and made in writing.

This agreement supercedes any prior agreements or understandings.
